Please read the terms and conditions set out below before booking with us. By booking your stay, you agree to comply with these terms and conditions (Terms and Conditions). If you do not agree, please refrain from booking. In these Terms and Conditions “we”, “us”, and “our”, means Vals Places, “you” or “your” means the person, organisation or entity that books with us. “landowner” means the person that owns the land where the home is located.
INTRODUCTION
These Terms and Conditions constitute a legally binding agreement between Vals Places and you. By booking a stay with us, you acknowledge that you have had sufficient opportunity to access and review these Terms and Conditions, and confirm that you have read, accepted and will comply with these Terms and Conditions.
Bookings are made through our website, by booking with Vals Places, you acknowledge you are over the age of 18. We may at our discretion, accept or reject any booking for any reason. If accepted a confirmation email will be sent to you by Vals Places. No bookings are confirmed until payment has been made in full.
Vals Places reserves the right to charge you a security bond. This bond will be held and returned upon confirmation that there has been no damage to the Tiny Home or any other breaches of the Terms and Conditions. If Vals Places or the landowner determine there has been damage, including but not limited to broken items, damage to the property or contents, or anything requiring extra cleaning, Vals Places reserves the right to absorb the bond held and charge your provided payment method to cover any additional cost as a result of the damage occurred.
Vals Places is a non-smoking property, any indication of smoking at the cabin (inside or in its surrounding grounds) will result in additional charges to your payment method provided including but not limited to for the purposes of additional cleaning or any works necessary to address any damage, smell, smoke or debris.
YOUR RESPONSIBILITY
Your stay is located in a rural area that comes with its own risks. You acknowledge that you are responsible for your own safety during your stay, including your guests and invitees.
Vals Places takes no responsibility for any of your actions, incidents or damage or loss of your personal property during your stay.
By booking your stay you accept these Terms and Conditions, you and your guests acknowledge that you will absolve the landowner and Vals Places from any liability associated with damages or injuries.
You acknowledge and agree to the following:
- Your stay at our accommodation and use of any facilities will be at your own risk.
- The number of occupants during your stay must not exceed the number of guests selected and confirmed during your booking. This does not include children under the age of 6.
- Children must be accompanied by at least one adult at all times during your stay in our accommodation and our accommodation cannot be booked without an adult also staying with that Child. Only adults may make bookings at our accommodation. For the purposes of this clause “Child” or “Children” means a person or persons aged between 2 years and 17 years and “Adult” means a person aged 18 years or over.
- Your stay is for leisure purposes only, excess noise, gatherings, functions or parties or illegal acts are not permitted.
- During your stay you must remain in the designated area outlined in your welcome pack. A parking space has been provided, this must be used while staying at the Tiny Home.
- Do not approach any animals you see on the property domestic or otherwise.
- Pets are not permitted during your stay.
- You agree to leave your accommodation and surrounding property in the same condition as when you arrived. You must notify us instantly if there has been any damage to the Tiny Home or surrounding property.
- It is your responsibility to turn off all appliances and utilities upon departure. Failure to do so will result in charges to cover the additional usage.
- You agree you must arrive and depart within the times and dates listed on your confirmation. For early and late departures that have not been pre-agreed via email, there will be an additional fee charged or your bond absorbed.
- You agree to be liable to us for the cost to repair any damage you (or any of your guests) cause to our accommodation during your stay and any excessive cleaning required as a result of you leaving the accommodation (or the surrounding property) in an excessively unclean state. The cost of such charges will be the costs we incur and cleaning will be charged at commercial rates.
We may enter the accommodation without your consent and require you to leave with no refund provided if we become aware of any misconduct or if any breach of these Terms and Conditions by you or your guests or invitees.
FACILITIES (AVAILABILITY AND MAINTENANCE)
From time to time, features and facilities of our accommodation may become unavailable or taken offline for repairs, maintenance or as we may deem necessary.
We will not be liable for omissions or errors, whether temporary or permanent, of the description of our accommodation’s facilities and services. Photos shown on our website (or any other location) are indicative only and may not specifically represent the accommodation booked by you.
Destination images featured on our website may not represent the views offered from our accommodation.
LIABILITY
To the maximum extent permitted by law, we and the landowner exclude all liability, and will have no liability, for:
- any acts or omissions of you;
- any acts or omissions of any third party;
- any event or circumstance beyond our or the landowner’s reasonable control;
- any information or documentation supplied by you.
You agree to indemnify Vals Places and the landowner harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your stay in our accommodation. This includes damages, insurance, loss due to fire, loss due to misadventure, theft, injury or death, whether they are inflicted or experienced in our accommodation or on the surrounding property.
Notwithstanding anything contained in these Terms and Conditions to the contrary and to the extent permitted by law and any warranty or guarantee provided under the Australian Consumer Law (which cannot be excluded, restricted or modified), we shall not be responsible for indirect damage, damage arising from consequential damage or special circumstances, including but not limited to loss of revenue, loss of profit, loss of use, loss of opportunity, arising out of the performance or non-performance of obligations under these Terms and Conditions or as otherwise implied by law.
Nothing contained in these terms and conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits us to limit our liability, then our liability is limited to:
In the case of services, supplying the services again or payment of the cost of having the services supplied again; and
In the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
PRIVACY POLICY
Vals Places is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.
We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why do we collect it?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect includes names, addresses, email addresses, phone and facsimile numbers.
This Personal Information is obtained in many ways including, correspondence, by telephone by email, via our website www.valspalces.com.au, from your website, from media and publications, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.
We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.
When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.
Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Sensitive information will be used by us only:
• For the primary purpose for which it was obtained
• For a secondary purpose that is directly related to the primary purpose
• With your consent; or where required or authorised by law.
Third Parties
Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.
Disclosure of Personal Information
Your Personal Information may be disclosed in a number of circumstances including the following:
• Third parties where you consent to the use or disclosure; and
• Where required or authorised by law.
Security of Personal Information
Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.
When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.
Access to your Personal Information
You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.
Vals Places will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.
In order to protect your Personal Information we may require identification from you before releasing the requested information.
Maintaining the Quality of your Personal Information
It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

CANCELLATION POLICY
All requested cancellations or amendments must be sent in writing and are subject to the following policy:
- 14 days or more before check in - cancellations are permitted. Otherwise, guests can choose to reschedule or receive a gift voucher for the full amount with no additional fees.
- Within 14 days of check in – no refund or change in date is permitted.
We do not provide any credit, refund or reschedule for non-arrivals or early departures. It is your responsibility to ensure you have read your confirmation and have the correct dates of stay.
There will be no credit, refund or reschedule provided for undesirable weather for your planned activities.
We recommend taking out travel insurance before your stay as there will be no credit, refund or reschedule provided if the conditions are considered safe in the location of the Tiny Home but you are unable to travel due to weather conditions.
Should there be extreme weather conditions in the location of your accommodation we will offer you a credit to redeem when it is safe to travel.
PRICING ERRORS
We reserve the right to cancel reservations based upon incorrect information being displayed in relation to price, inclusions or service at any point in time (at no cost to us).
GIFT VOUCHERS
Gift vouchers are valid for 36 months and are not refundable or exchangeable for cash.
Gift vouchers cannot be extended past the expiry date and the recipient must book and stay before the expiry date. Any unused amounts will be forfeited.
Gift vouchers are subject to availability and cannot be used in conjunction with any other promotions or special offers.
Gift vouchers used on long weekends and public holidays must have a 2 night minimum booking. This means that an additional payment may be necessary if your gift voucher is only for 1 night.
STAY ELEMENTS
Insect and Wildlife
You accept that you are staying in a regional area where you may encounter wildlife. You should under no circumstance approach any animal or wildlife. Wildlife is common in the area, neither Us nor the landowner accept any liability (nor will we issue a refund or credit) for the visits of any insects, livestock, vermin or wildlife, including, but not limited to, cattle, kangaroos, wallabies, wombats, birds, flies, midges, mosquitoes, spiders, snakes, ticks, leaches or rodents.
Campfire
When using the campfire for any reason, you must use the designated fire-pit and never leave the fire unattended. All fires must be put out before going to bed or leaving the area. You must also adhere to local fire ban rules. You acknowledge that there are risks involved when around a fire, neither us nor the landowner accept any liability for injury caused in connection with any use of campfire.
Composting Toilet
Our Tiny home is equip with a composting toilet for your use. You will be provided with instructions for using the composting toilet.
Under no circumstance are you permitted to place any item other than the provided toilet paper and hemp into the chamber.
If You are found to have placed anything other than the provided items for this service, this may result in additional charges to you.
EMERGENCIES
In the event of an emergency please call 000 for fire, ambulance or police.

SEVERABILITY
If any part of these Terms and Conditions should be determined invalid by reason of the relevant laws, it shall be removed without affecting the rest of the terms and conditions. The remaining Terms and Conditions will continue to be valid and enforceable.
NO WAIVER
Failure to insist upon or enforce strict performance of any of these Terms and Conditions shall not constitute a waiver of these Terms and Conditions.
GOVERNING LAW AND JURISDICTION
These Terms and Conditions (and any booking) are governed by the law of the jurisdiction our accommodation is located in and you agree to submit to that jurisdiction (unless we have otherwise agreed in writing).
